These Operator Terms apply to all operators, venues, and businesses using the Disco platform. By creating an operator account or using Disco, you agree to these terms.
1. About Disco
Disco is a hospitality staffing marketplace connecting hospitality operators with independent hospitality workers seeking flexible shifts.
Disco provides technology and marketplace tools only.
2. Platform Role
Disco acts solely as a marketplace platform.
Disco does not:
- Employ workers
- Provide payroll services
- Guarantee worker availability
- Supervise workers during shifts
- Act as the legal employer of workers
Operators are solely responsible for their relationships and arrangements with workers.
3. Operator Eligibility
To use Disco as an operator, you must:
- Be legally authorized to represent a business or venue
- Operate lawfully within the United Kingdom
- Provide accurate business information
- Comply with applicable employment and tax laws
4. Operator Responsibilities
Operators are fully responsible for:
- Shift accuracy and job descriptions
- Worker payments
- Conducting all legally required right-to-work and employment eligibility checks before permitting workers to perform shifts
- Health and safety compliance
- Insurance coverage
- Workplace supervision
- Compliance with employment legislation
Operators agree to provide safe, lawful, and respectful working environments.
5. Insurance Requirements
Operators are responsible for maintaining any legally required insurance, including where applicable:
- Employer’s liability insurance
- Public liability insurance
- Business insurance
Disco may request evidence of insurance or business verification at its discretion.
6. Shift Listings
Operators may post shifts through the platform.
Operators agree that shift listings must:
- Be accurate and truthful
- Contain lawful working conditions
- Clearly describe expectations and pay rates
- Not contain discriminatory or abusive content
7. Worker Selection
Operators are solely responsible for deciding which workers to accept, invite, or book.
Disco does not guarantee worker suitability, qualifications, reliability, or performance.
8. Payments
Unless explicitly stated otherwise, Disco does not process payments between operators and workers.
Operators are solely responsible for:
- Paying workers correctly and on time
- Managing payroll obligations
- Handling tax and pension obligations
- Resolving payment disputes
Disco accepts no liability for unpaid wages, disputes, or payroll errors.
9. Worker Data and Privacy
Operators may access limited worker information through the platform for staffing purposes.
Operators agree to:
- Use worker data responsibly
- Comply with applicable privacy and data protection laws
- Not misuse or sell worker information
10. Reliability Metrics and Ratings
Disco may display worker reliability metrics, profile data, skills, activity history, or ranking systems.
These metrics are informational only and do not guarantee worker performance.
11. Prohibited Conduct
Operators must not:
- Post misleading or fraudulent shifts
- Discriminate unlawfully against workers
- Harass or abuse workers
- Attempt to exploit or damage the platform
- Use Disco for unlawful purposes
12. Account Suspension and Removal
Disco may suspend or terminate operator accounts where users:
- Violate these terms
- Create safety or legal risks
- Engage in abusive conduct
- Provide false information
13. No Guarantee of Service
Disco does not guarantee:
- Worker availability
- Successful bookings
- Continuous platform access
- Business outcomes
Platform features may change, be updated, or removed at any time.
14. Right to Work Compliance
Operators are solely responsible for conducting all legally required right-to-work checks and verifying worker eligibility before allowing workers to perform shifts.
Disco does not independently verify immigration status, visas, work permits, or employment eligibility unless explicitly stated otherwise.
15. Limitation of Liability
To the fullest extent permitted by law, Disco shall not be liable for:
- Worker conduct
- Business interruption
- Lost profits or revenue
- Workplace incidents
- Missed shifts or cancellations
- Indirect or consequential losses
Operators use the platform at their own risk.
16. Indemnity
Operators agree to indemnify and hold Disco harmless against claims, liabilities, losses, damages, and legal expenses arising from:
- Employment disputes
- Workplace incidents
- Legal violations
- Operator misuse of the platform
17. Privacy
Use of Disco is also governed by the Disco Privacy Policy.
18. Changes to These Terms
Disco may update these Operator Terms periodically.
Continued use of the platform after updates constitutes acceptance of revised terms.
19. Governing Law
These terms are governed by the laws of England and Wales.
